Allevion, Inc. (“Allevion,” “Company,” “we”, “us,” “our,”) provides online services via the website located at www.surgeo.com (“Surgeo.com” or the “Site”).  Allevion is committed to maintaining the privacy, integrity, and security of any personally identifiable information about its users.  This Privacy Policy explains how we protect personally identifiable information we collect in connection with your use of the Site and the services provided therein, and how we use and in some cases disclose that information.

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use.

Information Collected

When you access or use the Site, we may collect two types of information: (1) personally identifiable information; and (2) information that is not personally identifiable.  Allevion will only share your personally identifiable information with third parties as outlined herein or as otherwise permitted by law.

Use of Personally Identifiable Information

Personally identifiable information includes information that identifies you personally, alone or in combination with other information available to us.  Examples of personally identifiable information may include an individual’s name, address, telephone number, email address, and credit card information.

As part of the standard operation of the Site, you may submit personally identifiable information.  For example, when you create an account or register for our service, or fill out a Consultation Request Form, you may provide personally identifiable information.  Should you attempt to communicate with us via the Site or via email, you may provide us with personally identifiable information.  In addition, you may, at your option, provide additional personally identifiable information about yourself. When you visit the Site, however, you are not required to create an account with the Site or provide any personally identifiable information.

If you email us, we may keep your message, email address, contact information, and other personally identifiable information.

Allevion may use personal information for a number of purposes such as:

  • To provide you with service via the Site, including customizing your experience on the website;
  • To provide you with service, including human attendant and call center support;
  • To contact you when necessary, including responding to your requests;
  • To communicate with insurance carriers whose information you provide;
  • To communicate with third parties involved in providing you with financial protection in the event of complications
  • To communicate with payment assistance partners who may be working with you, your employer, other parties, and/or us.
  • To share user information with other users at your direction;
  • To contact you with information and promotional materials and offers from us as well as from our affiliates, partners and other third parties, if you have agreed to receive such communications;
  • To process a transaction as requested by you via the services on the Site;
  • To administer the Site, monitor its usage, and diagnose problems with it;
  • To remember you when you return to the Site, so that you don’t have to re-submit information and preferences;
  • To enforce the Terms of Use or to protect Allevion’s rights, the rights of affiliates or related third parties, or to take legal action;
  • To protect a third party’s health, safety, or welfare;
  • To protect the security or integrity of the Site and our business; and
  • As otherwise necessary or useful in connection with Allevion’s operation of our services and business.

In addition to the examples above, Allevion may use third-party storage or service-provider companies to perform some functions related to Allevion’s services, including the processing and maintenance of data and email. Allevion may also combine personally identifiable information with other information received from you, whether online of offline, or from other sources.

Allevion may sell, transfer, or otherwise share some or all of our assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

Allevion may also disclose personally identifiable information to protect our rights or property, to enforce our terms of use and legal notices, as required or permitted by law, or at the request of government regulators or other law enforcement officials and the courts (including the issuance of a valid subpoena).  We shall have no duty to notify you of such compliance with the law.

From time to time, Allevion may allow posting on our website (e.g., chat rooms, social media applications, etc.).  You have the option not to post personally identifiable information in publicly available portions of the Site. If you submit personally identifiable information in a public portion of the Site, that information will be visible and available for access by visitors.

We have the right, but not the obligation, to: (1) retain your personally identifiable information for as long as your account is active or as needed to provide you services or access to or use of the Site; and (2) retain and use your personally identifiable information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Use of Non-Personal Information

Non-personal information includes information that is used in the aggregate such as your browser type, operating system, IP address and the domain name from which you accessed the Site.  In addition, we may collect information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site, the referring web page, pages visited, location, your mobile carrier, device and application ID’s and other click-stream data.

Allevion may use and disclose your non-personal information internally and to third parties unless restricted by this Privacy Policy or by law.  Examples of uses of non-personal information include:

  • Customizing your Site experience by recording your preferences;
  • Tracking the paths of visitors to better understand the resources visitors want;
  • To prepare reports regarding Site use, activity, and statistics;
  • To provide you with customized content and advertising and for various products or services; and
  • For marketing, product development, and research purposes;

We have the right, but not the obligation, to retain your non-personal information whether your account is active, inactive, or deactivated.

HIPAA Notice of Privacy Policy

Allevion and the Site provide our users access to a network of highly qualified surgeons and medical providers.  Through the offering of those services, you may provide health and medical information protected under the Health Insurance Portability and Accountability Act (“HIPAA”) and the Health Information Technology for Economic and Clinical Health (HITECH).  To understand our practice related to disclosure of protected health information under HIPAA and HITECH, please review our HIPAA Policy.

Cookies and Other Technology

Allevion may use “cookies” and other technologies such as pixel tags and web beacons.

Cookies are alphanumeric identifies in the form of text files that are inserted and stored by your Web browser on your computer’s storage device. These technologies tell us which parts of our Site you have visited, limit the number of times you see an offer, help us better determine which offers you may like to see, or to alert you to software compatibility issues. They are also used to analyze and improve our Site’s design and functionality.

If you choose to delete cookies from your device or block them from being stored on your device, please note that the full functionality of the Site may not be available to you.

“Web beacons” are images embedded in a Web page or email for the purpose of measuring and analyzing Site usage and activity. Allevion, or third party service providers acting on our behalf, may use Web beacons to help us analyze Site usage and improve Site.

We may use third party service providers to help us analyze certain online activities and improve our products, services, and Site. For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity on the Site. We may permit these service providers to use cookies and other technologies to perform these services for Allevion. We do not share any Personal Information about our customers with these third party service providers, and these service providers do not collect such information on our behalf. Our third party service providers are required to comply fully with this Privacy Policy.

Do not Track

Certain browsers have settings that allow you to turn on a “Do Not Track” (“DNT”) feature.  Allevion does not currently respond to web browser DNT signals that provide a method to opt out of the collection of information about online activities over time and across third-party websites or online services.

From time to time, Allevion may use third-party service providers, including Google Analytics, and advertising partners to help provide the Site and our services and to help us understand the use of the Site.  These third-party service providers may use cookies, web beacons or similar technologies to collect information sent by your browser as part of a web page request, such as your IP address.  Third-party advertising partners help us display tailored content to you, serve advertising on our behalf, and may share certain information with us to help us measure ad quality and tailor ads.

This Privacy Policy does not cover the collection methods or use of the information collected by these vendors.  These vendors have their own privacy policies.  If you wish to not have your information used for the purpose of serving you targeted ads, you may be able to opt-out by visiting the Network Advertising Initiative opt-out page at http://www.networkadvertising.org/choices/ (or a similar online resource about behavioral advertising) and following the relevant instructions.  Please note that opting out prevents targeted advertising but does not prevent all advertising.  If you delete, block or otherwise restrict cookies, or if you use a different computer or Internet browser, then you may need to renew your opt-out choice.  To find out more about how Google Analytics collects and processes data and how to disable Google Analytics from being used in your browser, please visit “How Google uses data when you use our partners’ sites or apps” at http://www.google.com/policies/privacy/partners/ or the Google Analytics opt-out page at https://tools.google.com/dlpage/gaoptout.

Children’s Personally Identifiable Information

We do not direct the Site to nor do we knowingly collect any personally identifiable information from children under 13 (“children’s personally identifiable information”). Children under the age of 13 are specifically requested to not provide any personally identifiable information through this Site. If you become aware that a child has provided us with personally identifiable information without parental consent, please contact us at [email protected].  If we become aware that a child under 13 has provided us with personally identifiable information, we take commercially reasonable steps to remove such information and terminate the child's account.

Email Communications from Allevion

Allevion maintains email lists to keep interested parties informed about our company, events, products, support, and more. We do not sell the addresses on our list, but we may make information available to specific business partners, sponsors, or service providers. For example, Allevion may work with an independent call center and marketing agency to assist in delivering services and information to its customers and others.

Users may voluntarily request to join our mailing lists by signing up or opting in through a form on our Site. To be removed from an Allevion mailing list, simply contact us.  Opting out in this manner will not end transmission of service-related emails, such as email alerts.

Changing or Deleting Your Information

If your personally identifiable information changes, you may correct that information by logging into your account and updating the personally identifiable information or by sending an email message to [email protected] and putting the word “UPDATE” in the subject line of the message.  If you desire to cancel your account, please go to your account and follow the instructions to delete that account.

When you request cancellation of your account, your personally identifiable information will be deleted, except we reserve the right to maintain your name and email address in order to communicate with you should that need arise. Archival copies of your account information that exist within our back-up system will be deleted in accordance with our normal back-up expiration schedule. Following cancellation or termination of your account, Allevion may continue to utilize de-identified and anonymized historical data associated with your use of the Site and Allevion’s products and services.

Security

Your personally identifiable information will generally be stored in our databases or databases maintained by Allevion or our service providers. Most of these databases are stored on servers located in the United States.  Allevion may use third-party storage or service-provider companies to store your personally identifiable information, some of which may be outside of the United States.

We have taken certain physical, electronic, contractual and administrative steps to protect the confidentiality, security, and integrity of your personally identifiable information.  For example, when you register for the Service, Allevion may require a password from you for your privacy and security. This password is stored in an encrypted fashion on our systems.

However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee its absolute security.  It is your responsibility to maintain the confidentiality of your Site account information.  We exercise no control over how your information is stored, maintained or displayed by third parties or on third-party sites.

International Transfer

Your information may be transferred to—and maintained on—computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Allevion transfers information to the United States and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

EU and Swiss Safe Harbors

Allevion’s Site operated in the United States and is subject to United States law. Any personally identifiable information that you provide to Allevion is being provided to Allevion in the United States and may be hosted on United States servers. You consent to the transfer of your personally identifiable information to the United States. If you are accessing the Allevion’s Site from outside the United States, please be advised that United States law may not offer the same privacy protections as the law of your jurisdiction.

Allevion complies with the U.S. - EU Safe Harbor Framework and the U.S. - Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of Personal Information from European Union member countries and Switzerland. Allevion has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. In compliance with the Safe Harbor Principles, Allevion commits to resolve complaints about your privacy and our collection or use of your personally identifiable information. European Union and Swiss citizens with inquiries or complaints regarding this privacy policy should first contact Allevion support.

Allevion has further committed to refer unresolved privacy complaints under the Safe Harbor Principles to an independent dispute resolution mechanism, the BBB EU SAFE HARBOR, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed Allevion, please visit the BBB EU SAFE HARBOR web site at http://www.bbb.org/us/safe-harbor-complaints for more information and to file a complaint.

Users visiting our Site may find links to websites owned and operated by other organizations, such as credit services. Please note that when you click on one of these links, you are moving to another website. While we reviewed the linked sites at the time of the posting of the link, and only provide a link if we believe the content of a site is appropriate and of interest to visitors to our site, the content of those linked sites is the responsibility of the organization actually owning and/or operating the site. Allevion is not responsible for, and has no control over, the content or privacy policy of any linked site. We encourage you to read the privacy statements of any linked site as its privacy policy may differ from Allevion’s.

Changes to Site and Privacy Policy

We constantly update the features of the Site to better serve you and all our customers, so this policy may also be revised from time to time. Allevion may modify this policy without advance notice and any modifications are effective when they are posted here. The date last revised appears at the bottom of the Policy. Changes take effect immediately upon posting.
